Using our site and services

These terms apply when you use hemero.team, shop a Hemero team store, or order custom products from Hemero LLC. By using our site or placing an order, you agree to them. If you order for a team, school or program, you confirm you are allowed to do so on its behalf.

Please read Disputes. It includes a binding individual arbitration agreement and a class action waiver, and explains how to opt out of arbitration within 30 days.

These terms apply to orders delivered outside Vietnam and France. Orders delivered in Vietnam follow our Vietnam terms, and orders delivered in France our French terms of sale.

How custom orders work

There are two ways to order custom uniforms.

1. Design it in our 3D designer.

  • Design and order. Design your uniforms in our 3D designer, then place your order. Pick your in-hand date and add your roster: paste it, type it in, or invite parents to add their player's details. Nothing to pay when you place your order.
  • We check every detail. Within one business day, we check your design, logo and print files, roster and sizes, and confirm your colors with you. Then we send your Order Confirmation with a payment link.
  • Pay to approve. Paying your Order Confirmation approves it. Production starts once we receive your payment and your roster has locked.

2. Send us your idea.

  • Tell us what you need. Send photos, logos, sketches or looks you love. We design it and send you a link to review it.
  • Mockups. Most mockups are at no cost. Some ideas need more work, such as detailed custom artwork, redrawing a logo, or many rounds of changes. When that happens, we tell you the design fee before we start, and we begin only after you agree to it in writing. An agreed design fee is earned once the work starts, whether or not you place an order. We may decline any design request.
  • Approve your design. Nothing to pay for your uniforms until you approve it through that link (other than a design fee you agreed to). Your approval covers the design, colors, roster and quantities, and it is final.
  • Pay to start. We send your payment link. Production starts once we receive your payment and your roster has locked.

Either way, once you pay, your order is scheduled for production and can't be canceled. See our Refund Policy.

Your Order Confirmation (3D designer orders)

Placing an order on our site is a request. It is not a contract for us to produce your order. Before we make anything, we send you an Order Confirmation: a summary of your design, colors, roster, quantities, price and dates. Please check it carefully and tell us about any changes before you pay.

When you pay your Order Confirmation, or we accept your purchase order in writing, you approve everything in it. That approval is final. We make what is in your confirmed order.

Pricing and minimums

Prices on our site, in the 3D designer and in estimates are estimates. Your final price is in your Order Confirmation. Team pricing starts at 10 uniform sets. We can make fewer sets with a small-order fee. Prices include shipping within the US. International shipping is quoted with your order. Where sales tax applies, it is calculated from your shipping address when you pay and shown before you pay, unless you send us a valid tax-exempt certificate first. If a certificate turns out to be invalid, expired or not for this purchase, we may charge the sales tax later, and you agree to pay it.

Set pricing. When each player gets 2 uniform sets (home and away) or 3 (home, away and alt), every set costs less: through Nov 15, 2026, $67 a set for 2 sets and $65 for 3 (instead of $70); from Nov 16, 2026, 10% off for 2 sets and 20% off for 3 (off $95). Reorders with 2 or 3 sets get it too. It applies to the set and single-piece price (a jersey or shorts alone is 60% of the set price), never to stitched lettering or perforation. A set discount and a promo code never combine: you get the bigger one. No set goes below $65.

Promotional pricing applies only during the stated dates. To get it, an order must be submitted by the last day of the offer (Pacific time) and paid by the due date on its Order Confirmation, no later than 30 days after the offer ends. Players or items added after your Order Confirmation are priced on the date you add them. Offers and credits can’t be combined unless we say so, have no cash value and don’t apply to past orders. Each team gets one Coach’s Care Package per season, after its order is paid in full, and not for canceled or refunded orders. If an order is split, combined or changed to reach a minimum or an offer it doesn’t really qualify for, we may reprice it.

If a price is wrong because of a typo, a technical error, or a link or form changed outside the normal use of our site, we aren’t bound by it. We’ll correct it before you pay, or cancel the order and refund anything you paid.

Payment

We send a secure payment link with your Order Confirmation, so you can pay by card. You can also pay by check, ACH bank transfer or Zelle. Some larger orders may qualify for a deposit when we agree in writing. Production starts once we receive your payment in full, or the deposit we agreed to, and your roster has locked. The one exception is a purchase order we accept in writing (see Purchase orders).

An order counts as paid only when the money reaches us. A receipt, confirmation page or order status shown in error doesn’t make an unpaid order paid. If a payment is reversed or disputed for an order we delivered as confirmed, the amount and any bank fees are still owed, and we may hold your other orders until it’s settled. Please contact us before disputing a charge.

Your order shows a due date for final sizes and payment. Pay by that date to keep your in-hand date. If you pay later, your in-hand date moves. Rush timelines are not guaranteed until we confirm them in writing.

Purchase orders

Purchase orders are for schools, school districts and other public agencies. They are an exception we approve case by case, not a standard way to pay. We may decline any purchase order, or ask for a deposit or full payment instead, at our discretion and for any reason.

  • What we need. An official purchase order from your school or district that names Hemero LLC, lists your Order Confirmation number and total, and is signed by someone authorized to approve the spending.
  • When production starts. After we accept the purchase order in writing and confirm it with your business office. Until then, your dates aren’t held.
  • Payment terms. Your school or district receives the order on delivery and pays our invoice in full within 30 days of delivery (Net 30), unless the purchase order we accepted says otherwise. Your purchase order commits your school or district to pay for the order as confirmed, even if the products are no longer needed.
  • Limits. Until a school or district has paid an order with us, we may limit the total of its open purchase orders. Orders above that limit may need a deposit or payment first.
  • Late payment. If an invoice isn’t paid on time, we may hold new orders and team store payouts, require payment up front on future orders, and, where the law allows, charge a late fee of 1.5% per month on the unpaid balance, or the highest rate the law allows if that is lower. You agree to pay reasonable costs of collecting past-due amounts, including collection and attorney fees, to the extent the law allows.

3D previews, colors and sizing

Our 3D designer shows a digital preview of your design, not a physical sample. Mockups work the same way. So your design prints cleanly, we may make small adjustments to placement, scale and line weights. If a change is noticeable, we tell you before you pay.

Screens display color differently, and dyes and fabrics vary slightly by batch. We confirm your colors with you in your Order Confirmation. You can give us Pantone codes, and we print to them as closely as we can, but we can’t promise an exact match. Small shade differences from your screen, or between dye batches, are not defects. If a color comes out clearly different from the one you approved (for example, navy printed as royal blue), we reprint the affected items at our cost. Tell us within 7 days of delivery, with photos taken in daylight, while the items are unworn and unwashed. We may ask for the items back, at our cost. Samples are available on request.

Please check sizes against our size guide. We make the sizes on your confirmed roster.

Rosters and parent invites

You are responsible for your roster: names, numbers, spelling and sizes. That includes details entered by parents or players you invite. We check for obvious issues, but we make what is on your confirmed roster.

Your roster locks on the sizes and payment due date on your order, even if you pay early. Until then, you and the parents you invite can make changes. Changes after the roster lock date may move your in-hand date or add cost.

Before you share a roster, you confirm you are a coach or program staff member, 18 or older, with permission from your school, program or players’ parents to share the details with Hemero. Only add what we need to make the uniforms. When you invite parents to add their player's details, you confirm they expect to hear from Hemero about your team's order. We use their details only for that order, as described in our Privacy Policy.

Turnaround and delivery

We work back from your in-hand date. Turnaround is about 4 weeks for under 30 sets, about 5 weeks for 30 to 59 sets, and about 6 weeks for 60 sets or more, from when we receive your payment. These are estimates, not guarantees, and can change with holidays, shipping and customs. If you have a hard deadline, tell us before you pay so we can confirm in writing whether we can meet it. If our own delay misses an in-hand date we confirmed in writing, we upgrade shipping at our cost and, if items still arrive late, give a credit of up to 20% of the late items toward your next order, as our Refund Policy explains. We choose the remedy.

Risk of loss passes to you when the order is delivered to the shipping address you gave us. For delivery outside the US, customs duties and import taxes are paid by the customer unless your Order Confirmation says otherwise.

Team stores

Hemero runs online team stores for programs. Families and fans buy directly from Hemero. Hemero is the seller and handles payment, production and delivery. Stores are open for a set period, and orders are produced after the store closes. Program earnings from team store sales are set in a separate agreement with the program. Team store buyers must be 18 or older. Discount codes are for the people they were given to. We may cancel store orders that use a code in a way it wasn’t meant for, or whose payment didn’t go through. Team store purchases follow our Refund Policy.

Your logos and our designs

You keep ownership of your team names, logos and artwork. By uploading or sending them to us, you confirm you have the rights to every logo, sponsor mark and name in your order, and you give us permission to use them to make your order and run your team store. You also confirm your uniforms follow your league or school association rules. For example, many high school associations don't allow sponsor logos on game uniforms. You are responsible for any claims about content you provide, including claims that it infringes someone else's rights.

Hemero owns the original design work we create, including mockups, patterns and templates, until your order is paid in full. Our 3D designer, its templates and its design patterns belong to Hemero, and designs created with it may only be produced by Hemero. You may not have our designs produced elsewhere without our written permission. We may show finished products in our portfolio and social media unless you ask us in writing not to.

Using our site

Please don't misuse our site, including trying to break its security, copying it to resell, or uploading anything unlawful, offensive or that you don't have rights to. We may refuse any order or design request we believe is unlawful or harmful.

Please don’t use our site to see other people’s orders, to change prices, quantities or sizes outside the normal order steps, or to get around our checkout, minimums or offers. We may refuse or cancel any order, purchase order or team store purchase before production, for example for suspected fraud, abuse of an offer, a pricing error or artwork we can’t print. If we cancel, we refund what you paid for that order. We may also refuse future orders and close related accounts.

Our promise and its limits

We stand behind our work. If your order arrives defective or damaged, or doesn't match your Order Confirmation or approved design, we'll make it right as described in our Refund Policy. Apart from that, our products and site are provided as is, to the extent the law allows. Our total liability for any claim related to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses, such as missed events, to the extent the law allows.

Delays outside our control

We aren’t responsible for delays or failures caused by events outside our reasonable control, such as carrier or customs delays, weather, natural disasters, power or internet outages, supplier or material shortages, labor disputes, government action, epidemics or public emergencies. If one happens, we’ll tell you, and your dates move by the time it takes to recover.

Emails and text messages

By giving us your email or mobile number, you agree that we can contact you about your request, order, roster and delivery, and that these messages and our electronic records count as written notice. If you choose text as your best way to reach you, you agree to receive order texts from Hemero. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to texts is not a condition of buying. Marketing emails and texts are sent only if you sign up, and you can opt out anytime.

Your responsibility for claims

You agree to defend, indemnify and hold harmless Hemero LLC and its owners, staff and partners from claims, losses and costs, including reasonable attorney fees, that come from content you provide (names, logos, artwork, sponsor marks), from your breach of these terms, or from your use of our products in a way that breaks league, school or association rules.

Disputes

If something goes wrong, contact us first at info@hemero.team. Most issues are solved quickly. Before starting a formal claim, either side must send a written description of the issue and give the other 30 days to try to resolve it.

These terms are governed by the laws of the State of California and the Federal Arbitration Act. Any dispute that we can’t resolve together will be settled by binding arbitration administered by JAMS under its rules for consumer disputes where they apply, in the county where you live or in Los Angeles County, California, or by video if both sides agree. For claims by individuals, we pay the arbitration fees beyond what you would pay to file in court. Either side may instead bring an individual claim in small claims court. Nothing here stops you from reporting a concern to a government agency.

Opting out. You can opt out of arbitration within 30 days of first accepting these terms by emailing info@hemero.team with your name and “Arbitration opt-out.” Opting out doesn’t change anything else in these terms. Claims for public injunctive relief, where the law doesn’t allow them to be waived, go to court after any individual arbitration is complete.

Claims are brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative action, and the arbitrator may not combine claims of different customers. You and Hemero each give up the right to a jury trial. Any claim must be brought within one year after it arises, to the extent the law allows. If any part of this section can’t be enforced, the rest still applies, but the class action waiver can’t be removed without removing the arbitration agreement for that claim.

California residents. Under California Civil Code Section 1789.3, you can reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

The fine print

These terms, together with your Order Confirmation (or approved design) and any written agreement we sign with you, are the whole agreement between us about your order. If your Order Confirmation says something different about price, quantities, sizes or dates, the Order Confirmation controls for that order. A school or district purchase order doesn’t add or change terms unless we agree in writing. If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we haven’t given it up. You may not transfer your order or these terms without our written OK; we may transfer them as part of a sale or reorganization of our business.

Changes

We may update these terms. The version posted on the date of your order applies to that order.

Hemero is a brand of Hemero LLC (United States), which runs hemero.team and the 3D designer. [Confirm how Hemero LLC and the Vietnam seller share these roles.]

When these terms say “Hemero” or “we”, they mean the seller above.

Who these terms are for

These terms apply when you order custom products on hemero.team for delivery to an address in Vietnam. By placing an order, you agree to them. Orders delivered outside Vietnam follow our US terms.

You must be 18 or older to order. If you order for a team, school or club, you confirm you are allowed to do so on its behalf.

Team stores are not available in Vietnam yet.

These terms are written in Vietnamese. The English version is for reference. If the two differ, the Vietnamese version applies.

How ordering works

1. Design it in 3D, or send us your idea. Pick a design, colors, names and numbers in our 3D designer. Or send us photos, logos and sketches, and we design it for you.

2. Place your order. Add your roster (player names, numbers and sizes) and a delivery address in Vietnam. Nothing to pay when you place your order.

3. We check every detail. Within one business day, we check your design, logos, roster and sizes, and confirm your colors with you. Then we email your Order Confirmation.

4. Pay to approve. Paying your Order Confirmation by bank transfer approves it. Production starts once we receive your payment and your roster has locked.

5. Delivery. We deliver to your address in Vietnam in about 2 to 3 weeks.

For send-your-idea orders, we send a link to review and approve your design before you pay. Your approval is final. Most mockups are at no cost. Extra work, such as detailed custom artwork, redrawing a logo or many rounds of changes, has a design fee we quote first and charge only with your written OK. An agreed design fee is earned once the work starts, whether or not you order.

Order Confirmation and the contract

Placing an order on our site is an offer to buy, not yet a contract. Our Order Confirmation lists your design, colors, roster, quantities, sizes, price in VND, delivery fee, payment due date and expected delivery date. Please check it carefully and tell us about any changes before you pay.

The contract is made when you pay your Order Confirmation. From then on, we make what it lists.

We keep a record of your order and Order Confirmation. Ask us for a copy at any time.

Prices, currency and promo codes

Prices for orders delivered in Vietnam are listed, quoted and paid only in Vietnamese dong (VND). Our VND prices are set once per quarter and rounded to the nearest 1,000 dong.

Prices on our site and in the 3D designer are estimates. Your final price in VND is in your Order Confirmation, and that is the amount you pay. Prices [include / do not include] VAT. The delivery fee and any other fee are listed separately in your Order Confirmation, before you pay.

Players or items added after your Order Confirmation are priced on the day you add them.

Promo codes.

  • Promo codes for Vietnam work only on orders delivered to an address in Vietnam.
  • One code per order. A code can’t be combined with another code or with any other offer.
  • Codes have no cash value and don’t apply to orders placed before you used them.
  • Each code has its own conditions and end date, published with it. If a code is used in a way it wasn’t meant for, we may not apply it, and we tell you before you pay.

If a price is clearly wrong because of a typo or a technical error, we tell you and correct it before you pay. If you don’t accept the corrected price, you can cancel at no cost.

Payment

Nothing to pay when you place your order. We send payment details with your Order Confirmation.

Bank transfer (VietQR). Scan the VietQR code in your Order Confirmation with your banking app, or transfer to:

  • Bank: [bank name, branch]
  • Account name: [account holder: the seller above]
  • Account number: [account number]
  • Transfer note: your order number, exactly as in your Order Confirmation.

Pay the exact amount in VND by the sizes and payment due date on your order to keep your delivery date. If you pay later, your delivery date moves. Your order counts as paid when the money reaches our account. We confirm by email.

Stay safe. We only ask you to pay to the account above, in the seller’s name. We never ask for your OTP, passwords or card details. If anyone asks you to pay to a different account, don’t pay, and contact us.

Every order is paid in full, by bank transfer, before production starts. We don’t take deposits or cash on delivery (COD), since every order is made only for your team.

Invoices: [Confirm: the seller issues an e-invoice for each paid order. For a company invoice, add the company name, tax code and address when you order.]

Refunds go back by bank transfer to the account you paid from.

Shipping and delivery

Where we deliver. To addresses in every province and city in Vietnam.

How long it takes. About 2 to 3 weeks from when we receive your payment and your roster has locked, delivery included. Your Order Confirmation shows the expected delivery date. Holidays such as Tết, weather or carrier delays can move it. If that happens, we tell you right away.

Delivery fee. Shown in your Order Confirmation, before you pay.

Who delivers. Our delivery partners: [carrier names]. We email your tracking details when your order ships.

Check it when it arrives. Before you sign, check that the package is sealed and undamaged. If the box is torn, wet or opened, tell the courier, take photos, refuse it if you need to, and tell us within 24 hours. Then count the items, check them against your Order Confirmation, and report any problem within 7 days, as our Returns policy explains.

Missed deliveries. The courier calls you before delivering. If delivery fails after several tries, we contact you to arrange another one. Extra delivery costs caused by a wrong address or no one to receive the package may be charged to you, so please give a phone number that will answer.

Changing the address. Tell us before your order ships. After that, we’ll try, but we can’t promise.

Lost or damaged in transit. We handle it with the carrier, and we remake or refund the affected items at our cost.

Ownership and risk pass to you when the order is delivered to the address you gave us.

3D previews, colors and sizes

Our 3D designer shows a digital preview, not a physical sample. So your design prints cleanly, we may make small adjustments to placement, scale and line weights. If a change is noticeable, we tell you before you pay.

Screens show color differently, and dyes vary slightly between batches. You can give us Pantone codes. We print as close to them as we can, but we can’t promise an exact match. Small shade differences are not defects. A color clearly different from the one you approved (for example, navy printed as royal blue) is a defect, and we reprint the affected items at our cost, as our Returns policy explains.

Please check sizes against our size guide. We make the sizes on your confirmed roster.

Rosters and players’ details

You are responsible for your roster: names, numbers, spelling and sizes, including what parents enter through your invite link. Your roster locks on the sizes and payment due date, even if you pay early. Changes after that may move your delivery date or add cost.

Many players are children. Before you add a player under 16, you confirm that their parent or guardian agrees to share the player’s details with us for this order. Only add what we need to make the uniforms. How we protect players’ details is in our Privacy policy.

Your logos and our designs

You keep ownership of your team names, logos and artwork. By sending them to us, you confirm you have the right to use every logo, sponsor mark and name in your order, and you let us use them to make your order.

We may refuse artwork that uses someone else’s trademarks or characters without permission, or that is offensive or unlawful.

Our 3D designer, its templates and design patterns, and the design work we create belong to Hemero. Designs made with them are produced only by Hemero, unless we agree in writing. We may show finished products on our site and social media unless you ask us in writing not to. Photos of players follow our Privacy policy.

Using our site

Please don’t misuse our site: don’t try to break its security, see other people’s orders, change prices outside the normal order steps, or upload anything unlawful. We may refuse or cancel an order before production for suspected fraud, abuse of an offer, a pricing error or artwork we can’t print. If we cancel, we refund everything you paid for that order.

Quality and our responsibility

We stand behind our work. If your order arrives defective or damaged, or doesn’t match your Order Confirmation, we make it right as our Returns policy explains. Nothing in these terms limits your rights as a consumer under Vietnamese law, including the seller’s responsibility for defective goods.

Events outside our reasonable control, such as natural disasters, epidemics, government action or network outages, may delay an order. If one happens, we tell you, agree the next steps with you, and your dates move by the time it takes to recover.

Emails, calls and texts

We contact you by email, phone or text about your order, roster and delivery. These messages and our electronic records count as written notice. We send marketing only if you agree, and you can say no at any time.

Complaints and disputes

If something goes wrong, contact us first. How we handle complaints, and how long each step takes, is in Complaints.

These terms follow the laws of Vietnam. A dispute we can’t settle together by negotiation or mediation goes to a competent court in Vietnam, or to arbitration if both sides agree in writing after the dispute arises.

Changes

We may update these terms and post the new version here with its date. The version in place on the day you placed your order applies to that order. We tell you about important changes before they apply.

Who these terms are for

These general terms of sale (the “terms”) apply to every order of custom products placed on hemero.team for delivery in metropolitan France, Corsica included. By ordering, you confirm you have read and accepted them.

For now we deliver under these terms only in metropolitan France and Corsica, not to Monaco, overseas France or other countries (Belgium, Switzerland and Luxembourg included). For delivery anywhere else, contact us before you order. Orders delivered in the United States follow our US terms.

They apply to consumers and to the clubs, associations and schools that order for their teams. A club or association that orders for its teams gets the same rights as a consumer under these terms, including the legal guarantees and the delivery rules. If you order for a company, for example a sponsor, contact us first: specific terms may apply.

You must be 18 or older to order. If you order for a team, club or school, you confirm you are allowed to act on its behalf.

These terms are written in French. The English version is a translation for reference only. If the two differ, the French version prevails.

Products

We make custom basketball uniforms: a jersey and shorts, sublimated with your design, colors, names, numbers and logos. Each uniform is made to order for your team. The main characteristics of each product (design, sizes, lettering, options) are shown on our site and in the 3D designer before you order.

Fiber composition: [to confirm, for example 100% polyester]. Care instructions are on the label.

Our 3D designer shows a digital preview, not a physical sample. So your design prints cleanly, we may make small adjustments to placement, scale and line weights. If a change is noticeable, we tell you before you pay.

Screens show color differently, and dyes vary slightly between batches. You can give us Pantone codes: we print as close to them as we can, but we can’t promise an exact match. Small shade differences are normal. A color clearly different from the one you approved (for example, navy printed as royal blue) is a lack of conformity, covered by the legal guarantees.

Please check sizes against our size guide. We make the sizes on your confirmed roster.

How ordering works

1. Design it in 3D, or send us your idea. Pick a design, colors, names and numbers in our 3D designer. Or send us photos, logos and sketches, and we design it for you.

2. Send your order request. Add your roster (player names, numbers and sizes) and a delivery address in France. Nothing to pay at this stage: your request doesn’t commit you to buy.

3. We check every detail. Within one business day, we check your design, logos, roster and sizes, confirm your colors with you, and email your Order Confirmation.

4. Pay to order. Your Order Confirmation lists everything we will make, the total price and the delivery date. You place your order by paying it, with the button “Order with obligation to pay” [to confirm: wording of the payment button]. That is when the contract is made. Production starts once we receive your payment and your roster has locked.

5. Delivery. We ship your order from our production facility to your address in France.

Please check your Order Confirmation carefully and tell us about any change before you pay. After payment, we email you the confirmation of your order with these terms. We keep a record of your order: ask us for a copy at any time.

Send-your-idea orders. We send a link to review and approve your design before you pay. Your approval of the design is final. Most mockups are at no cost. Extra work, such as detailed custom artwork, redrawing a logo or many rounds of changes, has a design fee we quote first and charge only with your written OK.

If you are a consumer, you have 14 days to withdraw from an agreed design service. If you ask us in writing to start before those 14 days end and then withdraw, you pay for the work already done. Once the design work is fully done at your express request, with your acknowledgment that you then lose the right to withdraw, it can no longer be withdrawn from (articles L221-25 and L221-28, 1° of the French Consumer Code).

You are responsible for your roster: names, numbers, spelling and sizes, including what parents enter through your invite link. Your roster locks on the sizes and payment due date shown on your order, even if you pay early. Changes after that may move your delivery date or add cost; we tell you before.

Many players are minors. Before you add a roster, you confirm you are 18 or older and have permission from your club, school or the players’ parents to share their details with us. Add only what we need to make the uniforms. How we protect players’ details is in our Privacy policy.

Prices

Prices are shown in euros, all taxes included (TTC): customs duties and import VAT are included, and we pay them. The delivery cost to your address in France is shown in your Order Confirmation, before you pay. You have nothing more to pay on delivery. Prices on our site and in the 3D designer are estimates. Your final total price, delivery, duties and taxes included, is in your Order Confirmation before you pay, and it is the amount you pay.

If you order for a company or a club registered for VAT in France, French rules make the import VAT payable on your own VAT return (self-assessment, usually deductible), so we can’t pay it for you. Tell us before you order and we show your price without that VAT.

Team pricing starts at 10 uniforms. Smaller orders have a small-order fee, shown before you pay. Players or items added after your Order Confirmation are priced on the day you add them.

Unless we say otherwise, offers and credits can’t be combined and have no cash value.

If a price is clearly wrong because of a typo or a technical error, we tell you and correct it before you pay. If you don’t accept the corrected price, you can cancel at no cost.

Payment

Nothing to pay when you send your order request. We send a secure payment link with your Order Confirmation.

  • Card: through our payment provider, Stripe. Your bank may ask you to confirm the payment (3-D Secure). We never see or store your full card number.
  • SEPA bank transfer: to the account shown in your Order Confirmation, in euros, with your order number as the reference. Only pay to the account in your Order Confirmation: if anyone asks you to pay to a different account, don’t pay, and contact us.

Payment is in euros, in full. Pay by the sizes and payment due date on your order to keep your delivery date. If you pay later, your delivery date moves. Your order counts as paid when the money reaches us, and we confirm it by email. Larger orders can pay a deposit first when we agree in writing.

We send an invoice for every paid order. Refunds go back to the payment method you used.

Delivery

Where. To the address in metropolitan France or Corsica given in your order.

When. Before you pay, your Order Confirmation shows the delivery date we commit to. It is usually about 4 weeks for fewer than 30 uniforms, 5 weeks for 30 to 59 and 6 weeks for 60 or more after we receive your payment and your roster has locked, shipping and customs included. If you have a hard deadline, tell us before you pay.

Shipping and customs. Your order ships from Vietnam by DHL Express, which handles customs clearance. We email your tracking details when it ships. Customs duties and import VAT are billed to us (DHL “Duty Tax Paid”): you have nothing to pay on delivery. The import is declared in your name, so we may ask you for the details customs needs (for a club, its name and SIRET number if it has one). If the carrier ever asks you for duties, taxes or clearance fees, contact us before paying: we settle them or refund what you paid.

If we are late. If we don’t deliver by the date in your Order Confirmation, you can ask us in writing to deliver within a reasonable extra time. If we still don’t, you can end the contract, and we refund everything you paid within 14 days. If the date was essential for you and you told us so before ordering, you can end the contract right away. These rights come from articles L216-1 and following of the French Consumer Code. Our extra commitments for late orders are in our Returns policy.

When it arrives. Check the package and count the items against your Order Confirmation. If the box is damaged, note it with the carrier if you can and tell us quickly, with photos: it helps us act fast with the carrier. This never limits your legal guarantees.

Risk of loss or damage passes to you when you, or someone you name, take physical possession of the order.

Right of withdrawal

Under article L221-28, 3° of the French Consumer Code, the right of withdrawal doesn’t apply to uniforms made to your specifications and clearly personalized (design, colors, names, numbers, logos). You are told this before you order, and it is repeated next to the payment button [to confirm: reminder shown on the payment page].

Before you pay, you can cancel your order request at no cost.

If we ever sell items that aren’t personalized (for example plain socks), you have 14 days from delivery to withdraw from them, as the law provides, and we give you the withdrawal form and the online withdrawal function for those items.

Legal guarantees

Every product we sell, personalized uniforms included, is covered by the legal guarantee of conformity and the legal guarantee against hidden defects. Our own commitments (color reprints, late-delivery credits, quick handling of claims) come on top of them and never limit them. Clubs and associations ordering for their teams get these same guarantees from us.

Legal guarantees: information required by law

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During that time, the consumer only has to show that the lack of conformity exists, not when it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, at no cost and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer gets a six-month extension of the original guarantee.

If the consumer asks for repair but the seller imposes replacement, the legal guarantee of conformity starts again for two years from the date the goods are replaced.

The consumer can get a reduction of the purchase price while keeping the goods, or end the contract and get a full refund in return for giving the goods back, if:

  • 1° The seller refuses to repair or replace the goods;
  • 2° The repair or replacement happens after thirty days;
  • 3° The repair or replacement causes the consumer a major inconvenience, in particular when the consumer finally bears the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
  • 4° The lack of conformity remains despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to end the contract when the lack of conformity is so serious that an immediate price reduction or ending of the contract is justified. The consumer then doesn’t have to ask for repair or replacement first.

The consumer is not entitled to end the sale if the lack of conformity is minor.

Any period during which the goods can’t be used because they are being repaired or replaced suspends the remaining guarantee until the goods are delivered back in working order.

The rights above result from articles L217-1 to L217-32 of the French Consumer Code.

A seller who obstructs the legal guarantee of conformity in bad faith faces a civil fine of up to 300,000 euros, which can be raised to 10% of average annual turnover (article L241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund in return for giving the goods back.

To use a legal guarantee, contact us at info@hemero.team with your order number, a description and photos. We bear the costs of sending items back and of the remake or replacement. How we handle it, step by step, is in our Returns policy.

Our responsibility

We are fully responsible for carrying out your order correctly, including the work of our production and delivery partners (article L221-15 of the French Consumer Code). We are not responsible only where a problem is caused by you, by the unforeseeable and insurmountable act of a third party, or by force majeure within the meaning of article 1218 of the French Civil Code, for example a natural disaster, an epidemic or a decision of the authorities. In that case, we tell you, agree the next steps with you, and the dates move by the time it takes to recover.

Nothing in these terms limits your rights as a consumer under French law.

Your logos and our designs

You keep the rights to your team names, logos and artwork. By sending them, you confirm you have the right to use every logo, sponsor mark and name in your order, and you allow us to reproduce them only to make your order. You also confirm your uniforms meet your league or federation rules.

We may refuse artwork that uses someone else’s trademarks or characters without permission, or that is offensive or unlawful.

Our 3D designer, its templates and design patterns, and the designs we create belong to Hemero. Designs made with them may be produced only by Hemero, unless we agree in writing. We may show finished products, without players, on our site and social media unless you tell us not to. Photos showing players follow our Privacy policy.

Personal data and messages

We process your data and players’ data as described in our Privacy policy.

We contact you by email, phone or text about your order, roster and delivery. These messages and our electronic records count as written notice. We send marketing only with your consent, and you can unsubscribe at any time.

Consumer mediation

We have chosen to join a consumer mediation scheme. If a dispute remains after a written complaint to us, you can refer it, at no cost to you, to our consumer mediator: [mediator name, website and address]. You must first have tried to settle the dispute with us by a written complaint, and you have one year from that complaint to refer it to the mediator (articles L612-1 and following of the French Consumer Code).

Applicable law and disputes

These terms are governed by French law. If you are a consumer, you can bring a dispute, at your choice, before the court of the place where you lived when the contract was made or when the harm occurred, or before any other court with jurisdiction (article R631-3 of the French Consumer Code).

Changes

We may update these terms and post the new version here with its date. The version in force on the day you pay your Order Confirmation applies to that order.
